Consumer Testing Privacy Policy

McCormick Canada is committed to protecting your privacy, including in relation to our consumer testing programs. This Policy, last revised November 20, 2015, applies specifically to the web site https://canadamccormickconsumertesting.at-hand.net and all other McCormick Canada websites that link to this policy (the “Consumer Testing Sites”). This web site is operated by La Cie McCormick Canada Co. (“McCormick Canada”).

Here at McCormick Canada, we recognize that many visitors to our Consumer Testing Sites may be concerned about the information we collect, and how we treat that information. Our Consumer Testing Privacy Policy is intended to help address those concerns.

Our Consumer Testing Privacy Policy

McCormick Canada is committed to ethical business dealings in all aspects of our business. The protection of personal information of consumers and customers is of the utmost importance for ensuring the integrity of our actions.

We commit to protecting all personal information in our possession or control. “Personal information” means any information, recorded in any form, about an identified individual, or an individual whose identity may be inferred or determined from the information. Personal information may include your name, address, email address, or phone number, and other personal indicia. McCormick Canada is committed to the following principles as they apply to the collection, use and disclosure of personal information.

Changes to the Consumer Testing Privacy Policy

As our practices change, we may make changes to this Consumer Testing Privacy Policy. We encourage you to review the Consumer Testing Privacy Policy from time to time, and we will let you know if we have made any material changes to the policy by posting a statement at the top of the policy for a period of at least 90 days. Your continued access to and/or use of a Consumer Testing Site or continued participation in consumer testing after any such changes constitutes your acceptance of, and agreement to be legally bound by, this Privacy Policy, as revised.

Accountability

McCormick Canada has appointed a Chief Privacy Officer to be accountable for the control of personal information and compliance with this Privacy Policy. To contact the Chief Privacy Officer, please use the information at the end of this Privacy Policy.

Your Consent to the Collection, Use and Disclosure of Your Personal Information

McCormick Canada will only collect, use and disclose your personal information with your consent, unless otherwise permitted or required by applicable law. You have the right to withdraw your consent to our collection, use and disclosure of your information by contacting our Privacy Officer. However, withdrawal of consent cannot be retroactive.

By applying to participate in McCormick Canada’s consumer testing program, or by providing personal information to one of our Consumer Testing Sites, you signify your consent to all of the terms of this Consumer Testing Privacy Policy. If you do not agree with any term of this policy, please do not participate in the programs or provide your personal information to us in connection with the programs.

Information We Collect

You don't need to provide any personal information to access the Consumer Testing Sites. However, you need to provide us with certain types of personal information in order to participate in McCormick Canada’s consumer testing program.

The information we collect may include, but is not limited to, name, contact information (address, telephone number and email address, which will be used as your username for logging into the Consumer Testing Sites, and in accordance with any other consents you may provide), date of birth, gender, race, field of employment, the type of tests in which you are available to participate, your opinions, whether you have food allergies or dietary restrictions, and whether you have any children under the age of majority who you could consider for consumer testing opportunities for children. In addition, we may take photographs, video and/or audio recordings of you with your express permission during your participation in a focus group or other Food-related sensory test or evaluation process for product development, market research, research reporting, advertising and related purposes for a period of 24 months following the date on which your express consent was provided by way of signing our Consumer Testing Release. We may also collect any other personal information that you voluntarily choose to submit to us.

Limiting Collection

The collection of your personal information will be limited to that which is necessary for the purposes identified at the time of collection, including without limitation conducting consumer testing, as identified in this Privacy Policy, as otherwise identified to you and to which you consent, or in compliance with applicable law. You will have the option to provide personal information relating to race and information relating to your minor children, and are not obligated to provide this information to us to participate in the consumer testing program.

McCormick Canada makes reasonable efforts to avoid the collection of information from children under the age of thirteen. If we believe we have received information from a person below thirteen years of age without the appropriate consent, we will destroy that personal information. If you believe that the information of your child under the age of thirteen has been collected by McCormick Canada, please contact our Chief Privacy Officer using the information at the end of this Privacy Policy.

If you provide us with information that you have children under the age of majority who would like to be considered for consumer testing opportunities for children, we will send you an email providing the option of having your children complete an online consumer testing survey if they are interested. If your child is between the ages of 13 and 18, we will obtain express consent from both the parent and the child before providing the option to complete an online consumer testing survey and at any other time if the child is asked to participate in any further consumer testing. However, as a parent or guardian, you can withdraw consent to use or disclose personal information for minors of all ages, including 16 years of age and over, at any time.

Use of Information

Personal information collected by McCormick Canada is used only for the purpose identified at the time of its collection, for the purpose for which the information was provided, as described in this Privacy Policy, for other purposes which are disclosed to you and to which you consent, or for such other purposes as may be permitted or required by law. In some cases, personal information may be collected and used for the reasons listed below:

  • Conduct and evaluate consumer testing of products
  • Send you messages regarding consumer testing of products
  • Administer and manage our consumer testing program
  • Record consumer views of products
  • Analyze consumer views of products demographically
  • Reduce business risk or loss
  • Enhance, develop, or modify products and services;
  • Enhance the Consumer Testing Sites
  • To conduct promotional activities, including advertising, where you have agreed to a release of likeness
  • Resolve consumer complaints

Sharing and Disclosure of Personal Information

We may share aggregated demographic information with our business associates. This is not linked to any personal information that can identify any individual person.

We will disclose your personal information to third parties only with your consent, as described in this policy, for the purposes described in this policy (including to help us administer or manage our consumer testing programs), for purposes set out in the Release and consent you have provided, or for such other purposes as may be permitted or required by law. We may also work with other parties to provide specific services, such as website technology services, or electronic mailing services. We may transfer your personal information to third party service providers that assist us with carrying out the purposes contemplated in this privacy policy. All third parties to whom personal information is provided are prohibited from using personal information except for the purpose of providing the requested services.

We reserve the right to transfer any personal information we have about you in the event that we merge with or are acquired by a third party, including in the event of a sale of McCormick Canada assets, subject to the applicable legal requirements regarding such transfer. We may also disclose your personal information to third parties if we have reason to believe that disclosing such information is necessary to: (i) conduct investigations of possible breaches of law; (ii) identify, contact, or bring legal action against someone who may be violating an agreement they have with us; or (iii) to protect our rights, safety or property. We may also disclose your information if permitted or required by law, including if required under a court order. Lastly, we may disclose your personal information for any other purpose to which you consent.

Retention of Personal Information

Personal information subject to this Privacy Policy will be retained only as long as necessary to fulfill the identified purpose, or as required by law. McCormick Canada reserves the rights to otherwise retain your personal information as may be required or permitted by law.

Accuracy and Access to Your Personal Information

McCormick Canada uses reasonable efforts to ensure all personal information is accurate, complete, and up to date for the purpose for which it is to be used. You have the right to access, verify and correct your personal information collected by McCormick Canada. To help us keep your personal information current, contact the McCormick Canada Chief Privacy Officer using the information provided at the end of this Privacy Policy.

When you ask to access your personal information, McCormick Canada will use reasonable efforts to comply with your request; however, in some cases we may not be able to allow you to access certain personal information in certain circumstances, for example if it contains personal information of other persons, or for legal reasons. In such cases, we will provide you with a reasonable explanation of why it is not possible to grant access to your personal information.

To the extent permitted by law, McCormick Canada assumes no responsibility for verifying the ongoing accuracy of personal information. Once advised that personal information is inaccurate, we will seek to amend the information and correct it with information provided by you.

Safeguards

McCormick Canada protects the security and confidentiality of personal information with safeguards appropriate to the sensitivity of the information. McCormick Canada treats your information as private, confidential information and we protect that information, both on-line and off-line. We use physical, technological and operational security systems to help protect personal information from loss, theft, misuse, alteration or destruction. Only personnel and third parties authorized by McCormick Canada have access to personal information and these individuals are contractually required to preserve the confidentiality of this information. Personal information we collect is maintained on servers located in Toronto, Ontario, Canada.

Although we have taken reasonable and prudent measures to protect our sites, computer systems and any personal information that we have collected from unauthorized use, access, disclosure, misuse, alteration or destruction, no security measures can provide absolute protection. As a result, while we are committed to protecting your personal information, we cannot ensure or warrant the security of any information you provide to us.

Transborder Transfer and Storage of Personal Information

Some or all of the personal information we collect may be stored or processed on servers located outside your jurisdiction of residence, including in the United States, whose data protection laws may differ from the jurisdiction in which you live. As a result, this information may be subject to access requests from governments, courts, or law enforcement in those jurisdictions according to laws in those jurisdictions. Subject to applicable laws in such other jurisdictions, we will use reasonable efforts to ensure that appropriate protections are in place to require the data processor in that country to maintain protections on the personal information that are equivalent to those that apply in Canada.

Newsletters

McCormick Canada websites may offer visitors the opportunity to sign up to receive newsletters regarding various consumer testing programs. To sign up, you will be required to provide personal contact information, such as an email address, and you will be required to opt-in to receiving electronic communications from McCormick Canada. McCormick Canada may use this information to send you promotional material and information electronically.

In the case of personal contact information provided in conjunction with any newsletter or other marketing initiatives, you can withdraw your consent to receiving those communications and unsubscribe to any McCormick Canada subscriptions at any time by contacting the McCormick Canada Privacy Officer using the information at the end of this Privacy Policy or by using the unsubscribe mechanism contained in every commercial electronic message. Commercial electronic communications sent by McCormick Canada to which you have subscribed will contain an unsubscribe mechanism.

Cookies and Log Files

The McCormick Canada Consumer Testing Sites use cookies. A cookie is a small amount of data, with identifying information that is sent to your browser and stored on your computer's hard drive. Information tracked through cookies may include, but is not limited to: (i) your IP address; (ii) the type of web browser and operating system being used; (iii) the pages of the website a user visits; (iv) date and time of visit; and (v) your internet service provider. McCormick Canada uses log files to record this information. A log file is simply a record stored on the web servers hosting the Consumer Testing Sites.

Cookies and log files may be used for the purpose of gathering page hit and path statistics, to analyze trends, administer the Consumer Testing Sites, track user's movements on our Consumer Testing Sites, personalize content or services, and gather broad demographic information for aggregate use. You may disable cookies through your web browser settings in most browsers. If you reject cookies, you may still use our websites, but your ability to use some areas of our sites will be limited and we will not be able to provide you with the most convenient experience.
